Terms and Conditions
Definitions:
Jonathan Wheeler Films - “JWF”
You - “The Customer”
JWF and the Customer - “the Parties”
The wedding or other event - “the Event”
Provision of a film or films - “the Services”
The fee for the Services agreed by the Parties - “the Fee”
1. JWF shall provide the Services at the Event. In the case of a wedding the Services shall include the ceremony together with the arrival and departure from the venue following the ceremony. Any further filming must be specifically agreed in writing.
2. The customer agrees to pay JMF the agreed Fee for the Services. A non- refundable deposit of £100 will be paid by the Customer to reserve the Services of JMW on the required date. The balance of the Fee will be paid 4 weeks prior to the day of the Event via bank transfer.
3. In the case of a wedding, JWF will be the only Videographer. Friends and family may film for personal purposes.

If JWF is unable to deliver the Services to the Customer due to causes outside their control (including, but not limited to, death, injury, sickness, car accident or breakdown, severe weather conditions, floods, storms, snow, traffic delays, pandemic etc.), JWF’s financial liability to the Customer shall be limited to the return of any amounts paid by the Customer.
5. The Customer agrees that JWF may reproduce or publish (online or otherwise) content acquired from the Services as samples of JWF’s work to be shown for marketing purposes.
6. The Customer has seen an example of JWF’s filming style and accepts that the Services will be provided in the same or similar style. JWF retains artistic licence as to which parts of the Event are included in the filming.
7. Unless the Customer advises otherwise, JWF will assume all persons attending the Event have consented to being filmed and all relevant permissions and licences have been obtained. The Customer must ensure that the guests at the wedding do not interfere with filming.
8. The Customer understands that JWF must respect the wishes and regulations of the venue organisers or those officiating at the Event which may limit filming and provision of the Services.
9. JWF shall not be held responsible for any lighting, sound or interference issues caused by circumstances outside of JWF’s control. This includes, but is not limited to, Venus restrictions, adverse noise or lighting issues, and equipment failure.
10. JWF shall endeavour to include requests from the Customer (for example the use of a particular piece of music) if they are made in writing prior to the Event. JWF cannot guarantee that such requests will be included.
11. JWF shall have the right to remove themselves and all equipment at any time there appears to be a potential danger to themselves or equipment. This may include, but is not limited to, aggressive or intoxicated people. In the event of only partial completion of the Services the Customer shall not be entitled to a refund or any other demand upon JWF.
12. In the event of hazardous weather conditions JWF reserves the right to remove all equipment to an indoor location. If this results in partial completion of the Services the Customer shall not be entitled to a refund or reduction in price.
13. At least 14 days before the Event the Customer shall confirm the day and provide JWF with all relevant details including time schedule and venue details.
14. JWF retains copyright to all footage recorded at the Event and does not provide the raw footage to the Customer.
15. The films will be provided to the Customer in HD format on a USB stick via post (or online if agreed between the Parties) within 4-12 weeks from the date of the Event. The Customer may make unlimited copies of the films provided they are for personal use only. If the Customer requires any minor changes to the films then they must advise JWF in writing within 7 days of receipt of the films.
16. If the Fee has been paid in full but the Event is moved to another date, there is no extra charge provided that JWF is available on the new date. If JWF is unavailable then the postponement will be treated as a cancellation.
17. If the Event is cancelled or the Services are no longer required then the Customer shall inform JWF immediately by email. Any deposit paid is non-refundable.
Cancellation 4-2 weeks before the Event shall require payment of 50% of the Fee. Cancellation 2-0 weeks before the Event shall require payment of 100% of the Fee.
18. JWF carries public liability insurance with a limit of indemnity of £1million.
19. In the unlikely event of complete equipment failure or other circumstances outside JWF’S control which means that the Event cannot be filmed the Customer shall receive a full refund. JWF will not be liable for any further damages.
